The experts noted that businesses are moving toward a model in which it is no longer sufficient to meet formal eligibility criteria. Companies must also ensure that their data remains accurate and consistently updated across government registries.

Businesses will also need to operate under stricter oversight of reservation quotas and salary thresholds, which directly affect their ability to retain critical enterprise status. In addition, greater emphasis is being placed on data synchronization between different state registries. Even minor data inconsistencies can create significant risks for companies, including employee status errors and potential issues during inspections.

The speakers also highlighted changes to the approach to data reconciliation with the Territorial Recruitment and Social Support Centers (TRSSС). For businesses, this means shifting from a reactive approach to a proactive one by planning reconciliation procedures in advance rather than responding only when requested by government authorities.

The webinar also covered the provisions of the Cabinet of Ministers of Ukraine Resolution No. 812, which updates Procedure No. 1487 and introduces mechanisms for electronic interaction between employers and government authorities. Key changes include revised rules for verifying military registration documents during hiring, the introduction of electronic data exchange, updated requirements for maintaining military records, and clearer reconciliation procedures. Experts also explained which data no longer needs to be updated regularly and what these changes mean for companies’ HR processes.

«The current changes to military record-keeping and employee reservation should be viewed as a transition to a new operational model of interaction between businesses and the state. It requires much greater reliance on a company’s internal processes — from HR record-keeping to regular synchronization with state systems.

In this new environment, a company’s critical enterprise status is determined not only by meeting formal requirements but also by its ability to continuously adapt to evolving regulations. This means that data management becomes an ongoing business function rather than a periodic task performed only during inspections or regulatory updates.

For HR and legal teams, this fundamentally changes the focus of their work. Instead of addressing isolated issues, they need to build systematic processes that ensure consistency, minimize the risk of data discrepancies, and enable companies to reliably maintain their critical enterprise status» said Nestor Shvets, Chief Legal Counsel at Lviv IT Cluster.

As part of its Legal Consulting project, the Lviv IT Cluster legal team continues to help IT companies navigate legislative changes by providing practical guidance and legal support.
